Terms & Conditions

Please read all terms and conditions very carefully before going into
any agreement with Tribe Design or Business Interaction Group or it’s
Partner sites. Terms & Conditions may be amended from time to time
and will be notified on this page.

Quotation
• Tribe Design will provide the services and products as mentioned on the website or as described in the quotations requested by the client, based on their specific requirements.

• All quotations are valid for 30 days. Tribe Design reserves the right to withdraw quotations within the 30 day period, unless a deposit has been paid by the client.

Payment
• A 50% deposit will be paid by the client to Tribe Design, based on the fees likely to be incurred as presented in the quote, before Tribe Design starts work on the client's account, excluding any initial speculative draft design.

• A 100% deposit will be paid by the client to Tribe Design, for all the Print offers and all the Start-up offers, products or services mentioned on the website or as presented in the quote, before Tribe Design starts work on the client's account or initiates the print process.

• Any features deemed by Tribe Design as additional to the existing quote are subject to an additional cost. In these circumstances, Tribe Design will give notice prior to implementation and seek agreement of the additional cost. An invoice for 50% of the costs of these additional features will be issued with payment due within 7 working days. The remaining 50% will be added to the final invoice.

• On completion of the services, work or goods provided, an invoice for all residual fees will be sent to the client. Tribe Design reserves the right to withhold or remove a website or any work Tribe Design creates for a client from publication or submission prior to full and complete payment.

• All payments are due prior to the launch of a website or any other service. If a client becomes unresponsive for more than a month at any point during the progress of a project we shall be entitled but not obliged forthwith to demand all payments due on a project including the final installment. Unresponsiveness includes but is not limited to, failure to communicate by email or telephone and failure to provide material in relation to progressing the website or any other service.

• All invoices are due for payment strictly within 7 working days of the date of invoice.

• Late payments will be subject to interest charges on any amount due or unpaid at the rate of 2.25% interest per month, calculated weekly and compounded monthly. Failure to apply interest does not constitute a waiver of the option to charge.

• For late payments, Tribe Design reserves the right to withdraw all services, until the outstanding debt is settled. This may include, but is not limited to, removing any material stored on any server, preventing access to any and all documents, papers, material etc. belonging to the client. Tribe Design is not obliged to keep electronic or paper copies of any such material for more than 3 months from the date they were supplied or created. Tribe Design shall not be liable for any loss monetary or otherwise, as a result of taking any such actions.

• VAT, of 17.5%, will be applied to all goods, products, work or services mentioned on the website or supplied or provided to the clients by Tribe Design in UK. The currency of all transactions will be Great British Pound Sterling.

Website Build and Services
• Website developed by Tribe Design will be built for compatibility with Microsoft Internet Explorer 5 and above.

• The client is responsible for securing copyright agreement for the use of any material submitted by them to Tribe Design for use in their project.

• Copyright of all material prepared in addition to the website by Tribe Design is reserved by Tribe Design.

• Tribe Design reserve the right to maintain a visible hyperlink on each page of a website it creates in part or whole, linking directly to the Tribe Design website homepage. This link is not to be removed or modified in anyway without the express written permission of Tribe Design.

• Tribe Design reserves the right to use the services of third parties.

• Tribe Design is not responsible for creating, supplying or checking any content, including images and text, for solutions we design or develop. The client is fully responsible for creating, supplying and checking all the content. The client is liable for uploading content to the different sections of the website solution. Tribe Design is not responsible for the quality of images or content supplied by the client. Tribe Design, Business Interaction Group or it’s Partner sites are not liable or responsible in any way, for any dispute arising before or after the launch of any website or service provided by Tribe Design.

Delivery Policy
• Upon receipt of final approval in writing from the client, and once all payments have been received, the ownership and copyright for the site will transfer to the client and the website will be launched, with the following restrictions:
(a) Images including but not limited to photographs and computer generated images, supplied by Tribe Design, remain the copyright of Tribe Design or their suppliers and may not be reproduced, electronically or in print, without the express written permission of Tribe Design. (b) Only one instance of a website can be made available on the World Wide Web. (c) No portion of the coding can be copied/duplicated or redistributed in any form internet, electronic, print or otherwise.

• On final written approval and final payment the client will be given full access to all the files of the website or Graphic Design or the Service.

• All data stored in an online database is the property of the client along with any rights and responsibilities associated with this, including, but not limited to, the clients responsibilities and duties in relation to the Data Protection Act.

• Tribe Design will provide standard Unix or Windows hosting, using an internal or external source, for the client for no additional charge for 12 months from the date of launch. No guarantees of service can be made by Tribe Design on behalf of the server performance. Bandwidth in excess of 1GB per month will be subject to additional charges. Alternative hosting arrangements will be subject to an additional charge. Subsequent set up fee and other annual charges will apply.

• The free first year hosting does include the domain name registration. Full rights of the domain name selected by the client or advised by Tribe Design, will remain with the client after registration with the registrar.

• The client agrees to allow Tribe Design to make all efforts to transfer an existing domain name to hosting provided by Tribe Design, for which there will be no additional charge. The client may be required to extend the registration period of the domain name to support this process and any associated cost of this will be passed onto the client.

Refund, Replacement and Cancellation Terms
• Any deposit paid is non-refundable.

• Any errors identified with work undertaken by Tribe Design must be notified in writing on immediate discovery of the error. Tribe Design will attempt to resolve any genuine errors as quickly as possible. Tribe Design cannot accept responsibility for any loss either monetary or otherwise due to any website errors on the server or otherwise.
